Welcome to Ceritalah. These Terms of Service ("Terms") govern your access to and use of the Ceritalah mobile application (the "App") and the website located at [Your Website URL] (the "Site"), operated by Think City Sdn Bhd ("we," "us," or "our").

1. Description of Service
Ceritalah is a digital heritage platform that provides augmented reality (AR) walking trails, immersive audio dramas, and digital archive collections. The App uses GPS and AR technology to overlay digital content onto physical locations.
2. Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you represent that you have your parent or guardian's permission to use the App and they agree to these Terms on your behalf.
3. Safety and User Conduct
A. Physical Safety: The App is intended for use in outdoor environments. You agree that your use of the App is at your own risk. You must remain aware of your surroundings at all times, follow traffic laws, and avoid trespassing on private property. B. AR Awareness: When using Augmented Reality features, ensure you are in a safe area. Do not use the App while driving, operating machinery, or engaging in any activity that requires your full attention. C. Prohibited Use: You may not use the App for any illegal purpose, to harass others, or to attempt to gain unauthorized access to our systems.
4. Accounts and Registration
To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. In-App Purchases and Payments
A. Storytrails: Certain content, such as specific "Storytrails," may require payment. B. Billing: Payments are processed through the Apple App Store or Google Play Store. You agree to comply with their respective terms of service regarding payments and refunds. C. Content Access: Purchased content is licensed, not sold, to you for your personal, non-commercial use within the App.
6. Intellectual Property
All content included in the App, including but not limited to text, graphics, logos, audio clips, AR assets, and software, is the property of Think City Sdn Bhd or its content suppliers and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive license to use the App for personal enjoyment.
7. Location Data and Privacy
The App requires access to your device’s GPS location to provide the AR walking trail experience. Our collection and use of this data are governed by our Privacy Policy. By using the App, you consent to the collection of location data as necessary for the App’s functionality.
8. Limitation of Liability
To the maximum extent permitted by law, Think City Sdn Bhd shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits or revenues, or any physical injury or property damage resulting from:
- Your use of or inability to use the App.
- Your reliance on any content or maps provided.
- Your physical actions while using the AR features.
9. Termination
We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date.
